Whereas, Under the authority of Act No. 2013-283, the City Council of the City of Foley can adopt a policy concerning firearms being carried in the building, premises, and facilities over which the City of Foley City Council exercises authority:

NOW, THEREFORE, be it resolved by the City Council of the City of Foley as follows:

Section 1.                     Except for the individuals identified in Section 2, no person shall carry a firearm of any kind in: (1) any area of the Foley Police Department Justice Center facility where access of unauthorized persons or prohibited articles are limited during normal hours of operation by continuous posting of guards and the use of other security features, including, but not limited to, magnetometers, key cards, biometric screening devices, turnstiles, or other physical barriers; or (2) any portion of any other buildings, premises or facilities owned, operated, or under the control of the City of Foley where access of unauthorized persons or prohibited articles are limited during normal hours of operation by the continuous posting of guards and the use of other security features, including, but not limited to, magnetometers, key cards, biometric screening devices, or turnstiles or other physical barriers. Except as set forth above, and except as otherwise provided by applicable state, county, or federal laws, rules and regulations, any person with a valid permit or license to carry a pistol in a vehicle or concealed on or about his or her person within this state shall also be authorized to carry a pistol in any building, premises or facility over which the Foley City Council exercises authority. 

Section 2.                     Subject to applicable state, county and federal laws, rules and regulations, all elected Alabama city, county and state officials, law enforcement officers, judges, retired judges, and assistant district attorneys who have valid permit or license to carry a pistol in a vehicle or concealed on or about his or her person within this state shall be authorized to carry a pistol in any area of the Foley Police Department Justice Center facility.

                     Section 3.                      This Resolution shall become effective immediately upon its adoption as required by law.
