WHEREAS, City of Foley Sports Tourism, Subtenant requested and Woerner AgriBusiness, LCC, Tenant, who leases the same property from Woerner Gulf Beach Express, Inc. agreed to transfer, set-over and assign Tenant's rights and obligations for the use and occupation of Fields 331 and 335 containing 34.6 +/- acres and being part of the property described on Exhibit "A" in the attached agreement, and
WHEREAS, Subtenant has agreed to assume the same, pursuant to the terms and conditions of the lease agreement.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves entering into a Sublease Agreement for the use and occupation of Fields 331 and 335, to be used to host Sports Toursim Department events, beginning on November 1, 2015 and expiring on April 1, 2016 in the amount of $5,000.00.
SECTION 2: Approves the transfer of $5,000.00 from Account # 01-628-8015/Travel & Training to Account #01-628-8075/Event Operations after adoption of the FY2016 Budget in support of this action.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
