ORDINANCE APPROVING INITIAL ZONING OF Babikow, Radford, Radford, Flowers & Horne Properties

WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and
WHEREAS, the City of Foley Zoning Ordinance requires that all property within the City be zoned, has received request that specific property within the City be zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and
WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, while in regular session as follows:
Section 1. That the official Zoning Map of the City of Foley, Alabama be amended to reflect the initial zoning of said property description as follows:
TRACT 1
Zoned B-3 (Local Business District)
(Babikow-PIN 100592): From the Southwest corner of the Northwest Quarter of Section 25, Township 7 South, Range 3 East, Baldwin County, AL run North approximately 75 feet to a point on the Northern Right-of-Way boundary of US Highway 98; thence run East approximately 25 feet to a point on the Western Right-of-Way boundary of an unused road and the Point of Beginning; thence run North along said unused Right-of-Way boundary approximately 1251 feet to a point; thence run East approximately 605 feet to a point; thence run South approximately 1079 feet to a point; thence run West approximately 228 feet to a point; thence run Northwesterly approximately 247 feet to a point; thence run West approximately 41 feet to a point; thence run Southwesterly approximately 273 feet to a point; thence run Southwesterly approximately 320 feet to a point on the Northern Right-of-Way boundary of US Highway 98; thence run West along said Right-of-Way boundary approximately 43.5 feet to the Point of Beginning. Said tract of land contains 13.75 acres, more or less.

(Radford-PIN 41839): From the Northwest corner of the Southwest Quarter of Section 16, Township 8 South, Range 4 East, Baldwin County, AL run East approximately 470 feet to a point; thence run South approximately 25 feet to a point on the Southern Right-of-Way boundary of Brinks Willis Road and the Point of Beginning of the property herein described; continue South approximately 640 feet to a point; thence run East approximately 198 feet to a point; thence run North approximately 640 feet to a point on the Southern Right-of-Way boundary of Brinks Willis Road; thence run West along said Southern Right-of-Way boundary approximately 198 feet to the Point of Beginning. Said tract of land contains 2.9 acres, more or less.

(Radford-PIN 234243): From the Northwest corner of the Southwest Quarter of Section 16, Township 8 South, Range 4 East, Baldwin County, AL run East approximately 670 feet to a point; thence run South approximately 25 feet to a point on the Southern Right-of-Way boundary of Brinks Willis Road and the Point of Beginning of the property herein described; continue South approximately 641 feet to a point; thence run East approximately 210 feet to a point; thence run North approximately 639 feet to a point on the Southern Right-of-Way boundary of Brinks Willis Road; thence run West along said Southern Right-of-Way boundary approximately 210 feet to the Point of Beginning. Said tract of land contains 3.08 acres, more or less.

(Flowers-PIN 44434): From the Northeast corner of the Southeast Quarter of Section 15, Township 8 South, Range 4 East, Baldwin County, AL run West approximately 424 feet to the Point of Beginning of the property herein described; thence run South approximately 1098 feet to a point; thence run West approximately 855 feet to a point; thence run North approximately 1081 feet to a point; thence run East approximately 852 feet to the Point of Beginning. Said tract of land contains 21.3 acres, more or less.

(Horne-PIN 54611): From the Southeast corner of the Northeast Quarter of Section 22, Township 8 South, Range 4 East, Baldwin County, AL run South approximately 38 feet to a point; thence run West approximately 43 feet to a point on the Western Right-of-Way boundary of Roscoe Road and the Point of Beginning of the property herein described; thence continue West approximately 1285 feet to a point; thence run North approximately 1352 feet to a point; thence run East approximately 1272 feet to a point on the Western Right-of-Way boundary of Roscoe Road; thence run South along said Western Right-of-Way boundary approximately 1350 feet to the Point of Beginning. Said tract of land contains 39.7 acres, more or less.
SECTION 2. That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.
SECTION 3: This Ordinance shall become effective immediately upon its adoption as required by law.
