WHEREAS, BC Foley, the City of Foley, and the Public Athletic and Sports Facilities Cooperative District all own portions of land commonly known as the BC Master Parcel, Pride Drive Parcel, Sports East Parcel and Sports West Parcel, and
WHEREAS, the Sports East Parcel will be used for parking and the Sports West Parcel will be used for Greenfields, and
WHEREAS, each entity has some form of drainage detention/discharge on their parcels that they wish to document in the form of an agreement.
NOW THEREFORE BE IT RESOLVED that the Public Athletic and Sports Facilities Cooperative District of the City of Foley, Alabama, as follows:
SECTION 1: Approves the attached "Drainage Facilities and Easement Agreement" in its entirety and is made a permanent part of this resolution upon its adoption setting forth each parties full understanding and agreement concerning storm water easements, rights, and benefits in this Agreement.
SECTION 2: Authorizes the Chairman to enter into a "Drainage Facilities and Easement Agreement" to set forth a full understanding concerning storm water easements, rights and benefits between the City of Foley, BC Foley and the City of Foley's Public Athletic and Sports Facilities Cooperative District.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
