This agreement is entered into by Southwest Alabama Regional Highway Safety Office, located at the Mobile County Commission, hereinafter referred to as “SWARHSO”, and the governing entity of the law enforcement department of the following:
Foley Police Department______ , hereinafter referred to as “AGENCY”, for official participation in the Southwest Region’s Community Traffic Safety Program (CTSP) grant(s), and for 100% funded salary, plus allowable FICA fringe, for overtime traffic safety enforcement (and other time as approved by ADECA and/or SWAHSO), and for traffic enforcement/traffic safety equipment, dependent upon approval of applicable grant(s). The term of this contract will be from October 01, 2015 through September 15, 2016; however, this contract period will not be the same as any grant’s authorized spending period during the fiscal year.

WHEREAS, ADECA and/or SWAHSO sets aside funds to used for overtime traffic enforcement and the Southwest Alabama Regional Highway Safety Office has agreed to pass a portion of those funds to the Foley Police Department, and
WHEREAS, the Southwest Alabama Regional Highway Safety Office has overtime grant funds, amount to be disclosed at a later date, for the Community Traffic Safety Program (CTSP), and
WHEREAS, the Southwest Alabama Regional Highway Safety Office funds 100% of salary plus allowable fringes for overtime enforcement service performed during October 1, 2015 through September 15, 2016.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Accepts the Southwest Alabama Regional Highway Safety Office, funds to be disclosed at a later date, for the Community Traffic Safety Program grant(s), for the period October 1, 2015 through September 15, 2016 to be used for traffic enforcement. The City understands there is no City match required.
SECTION 2: Appoints Kelly O'Donnell to serve as the traffic safety coordinator, who will be responsible for submitting required documentation, reports and reimbursement statements to SWARHSO on or before the 7th of the month following the month of performance.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
