WHEREAS, the City of Foley plans to make certain improvements at the Foley Municipal Airport; and
WHEREAS, the State of Alabama, acting by and through the Alabama Department of Transportation (ALDOT) and the Federal Aviation Administration (FAA) has certain funding and financial assistance programs that can help finance improvements at the Foley Municipal Airport.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: That the City of Foley is hereby authorized to make application to ALDOT and the FAA by submittal of both the initial pre-application and the grant application for airport improvement funding assistance for the purpose of undertaking an airport project in FAA fiscal year 2020, City of Foley fiscal year 2021.
SECTION 2: That either the Mayor or the Airport Manager of the City of Foley are hereby each authorized, directed, and empowered to apply for and to enter into an airport improvement funding agreement with the FAA and the State of Alabama, acting by and through the Alabama Department of Transportation, including all understandings and assurances contained therein, and to each act in connection with the application and agreement and to provide such additional information as may be requested.
SECTION 3: That the authority of the City of Foley to enter into contracts with the State of Alabama and the FAA has been reviewed by the City of Foley attorney, and in his opinion, the City of Foley is duly authorized to commit the City of Foley to an agreement with ALDOT and the FAA.
SECTION 4: That the City of Foley hereby affirms that the local matching share of the money required to complete the project will be officially approved, placed in the budget, and available for expenditure upon execution of the FAA and State of Alabama’s funding agreement that includes the project budget, prior to the commencement of this project.
SECTION 5: This Resolution shall become effective immediately upon its adoption as required by law.
