    WHEREAS, the existing drainage ditch in the tributary of Wolf Creek between North Alston Street and AL 59, in the area of West Section Avenue to the north and West Marigold Avenue to the south is severly eroded and requires maintenance to prevent further damage to adjoining properties, and
 
    WHEREAS, the Engineering Department has acquired an easement from Nigel Dingwall for the City of Foley to assume maintence of the drainage ditch.
 
    NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
 
    SECTION 1:     Approves and accepts a permanent drainage and maintenance easement for Lots 1, 8 and 9 as shown on Slide No. 15-A in the records of the Office of the Judge of Probate of Baldwin County, Alabama.
 
    SECTION 2:     This Resolution shall become effective immediately upon its adoption as required by law.
