AN ORDINANCE DECLARING CERTAIN REAL PROPERTY NO LONGER NEEDED FOR MUNICIPAL PURPOSES AND AUTHORIZING THE CONVEYANCE OF SAME TO IRH FOLEY LLC FOR NOMINAL CONSIDERATION FOR A PUBLIC BENEFIT AND PUBLIC PURPOSE

WHEREAS, the City of Foley owns certain vacant property that is centrally located between various business who employ large numbers of seasonal employees; and
WHEREAS, the City of Foley heavily relies on sales tax revenues and business license fees based on business revenues to provide necessary municipal services; and
WHEREAS, there is a shortage of workers to fill all the jobs available in the City of Foley; and
WHEREAS, one of the main obstacles to recruiting workers to take on jobs in the City of Foley is the lack of affordable housing; and
WHEREAS, the City of Foley has determined that the inadequate supply of workers is a threat to success of the existing businesses and to the recruitment of new businesses; and
WHEREAS, IRH Foley LLC desires and intends to build dormitory-style housing primarily for J-1 Visa holders who are interested in coming to the United States temporarily to work; and
WHEREAS, the IRH Foley LLC J-1 Visa workforce housing project will serve a public purpose by facilitating a much needed supplemental and alternative supply of potential employees for the businesses on which the City of Foley’s revenues depend; and
WHEREAS, the City of Foley desires to encourage and incentivize IRH Foley LLC to construct a J-1 Visa workforce housing project by conveying real property at nominal consideration but with certain conditions to ensure that the property is returned to the City if the municipal benefits from the project are not realized;
WHEREAS the City finds that it will serve a public purpose to donate the surplus property to IRH Foley LLC to facilitate the alternative workforce housing program;
NOW THEREFORE, be it ordained by the City Council of the City of Foley as follows:
1. That the City Council hereby finds and declares that the following property is surplus, is no longer needed for municipal purposes, and that it is in the best interests of the City of Foley to convey the same to IRH Foley LLC:
Lot 1, Sportstown Village Subdivision, Phase 1, a map of which is recorded in Slide 2604-B, in the Probate Office of Baldwin County, Alabama.

2. That, pursuant to Code of Alabama, Section 11-47-20 and applicable law, the Mayor and City Clerk of the City of Foley are hereby authorized and directed to execute, acknowledge, attest and deliver a deed in substantially the form attached hereto as Exhibit “A” (but subject to legal review) to IRH Foley, LLC for the Subject Property.
3. That the officers of the City, or any one or more of them, are hereby authorized and directed to do and perform or cause to be done or performed in the name and on behalf of the City such other acts, and execute, deliver, file and record such other instruments, documents, certificates, and notifications, all as shall be required by law or necessary or desirable to carry out the provisions and purposes of this Ordinance.
4. That any prior actions taken or agreements made or documents executed by any officers of the City in connection with the transactions herein authorized and approved are hereby ratified, confirmed and approved.
5. That this Ordinance shall take effect immediately after its publication as required by law, and all resolutions, ordinances, orders, or parts thereof in conflict or inconsistent with any provision herein are, to the extent of such conflict or inconsistency, hereby repealed.
