ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY

OWNED BY CHEN REALTY COMPANY INCORPORATED FROM B1A - EXTENDED BUSINESS DISTRICT TO R3 - RESIDENTIAL MULTI-FAMILY DISTRICT

 

                     WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a new Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

 

                     WHEREAS, the Planning Commission has recommended approval of this rezoning, and

                     WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

                     WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met,

                     NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session accepted the following changes:

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned B1A - Extended Business District to R3 - Residential Multi-Family District said property description as follows:

 

LEGAL DESCRIPTION:

Lots 1A, 2A, and 3A, of the Phase One AFCO Commercial Subdivision as found recorded in the Office of the Judge of Probate of Baldwin County, Alabama on Slide No. 2173-C. Said Lots being located in the Southeast 1/4 of the Northeast 1/4 of Section 8, Township 8 South, Range 4 East, and containing 25.87 acres, more or less.

 

AND:

 

A lot or parcel of land being located in the City of Foley, Baldwin County, Alabama and being more particularly described as follows:

 

BEGINNING at an Existing Iron Pin (EIP) marking the Southeast corner of Lot 15 of Pine Grove Subdivision as found recorded in the Office of the Judge of Probate of Baldwin County, Alabama, in Plat Book 3, Page 55 and being on the North Right of Way (R/W) of Baldwin County Road No. 20 South; thence along the said North R/W bearing S 89°47'58" W a distance of 180.03 FT to an EIP (Crimp Top) on the South line of Lot 17 of said Pine Grove Subdivision; thence depart said North R/W bearing N 00°04'27" E a distance of 171.27 FT to an EIP (Illegible) on the North line of said Lot 17; thence along said North line and the extension thereof bearing S 89°48'23" E a distance 179.90 FT to an EIP (Crimp Top) marking the Northeast corner of said Lot 15; thence along the East line of said Lot 15 bearing S 00°01'42" W a distance of 171.32 FT to the POINT OF BEGINNING. Said Parcel being located in the Southeast 1/4 of the Northwest 1/4 of Section 8, Township 8 South, Range 4 East, and containing 0.70 acres, more or less.

SECTION 2: That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3:  This Ordinance shall become effective immediately upon its adoption as required by law.
