WHEREAS, the City of Foley plans to make certain drainage improvements to the Foley Municipal Airport; and
WHEREAS, Resolution Number 14-0473-RES previously approved making an application and entering into agreements with to the State of Alabama Department of Transportation (ALDOT) for funding assistance for this project; and
WHEREAS, ALDOT also acts as the agent for municipalities like the City of Foley to apply for, receive, and disburse federal funds that are available through the Federal Aviation Administration (FAA); and
WHEREAS, in addition to State funding through ALDOT, the City of Foley also sought Federal funds from the FAA for this project; and
WHEREAS, the City of Foley has received offers and/or approvals from both the ALDOT and the FAA for funding assistance for this project; and
WHEREAS, the City Council of the City of Foley wants to ratify and approve all the previous actions taken by agents, officers, officials and employees of the City of Foley and to authorize and direct its agents, officers, officials and employees to take further actions to apply for, secure, accept, and comply with the grant and funding terms of the FAA;
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: That all previous actions, communications, and applications made or taken by City of Foley agents, officers, officials, and employees seeking funding assistance from the FAA for drainage improvements for the City of Foley Municipal Airport are hereby ratified, accepted, approved, and affirmed.
SECTION 2: That the City of Foley is hereby authorized to make an application to and to enter into an agreement with the FAA for airport improvement funding assistance for the drainage improvement project.
Section 3: That either the Mayor or the Airport Manager of the City of Foley are hereby each authorized, directed, and empowered to apply for and to enter into an airport improvement funding agreement with the FAA, including all understandings and assurances contained therein, and to each act in connection with the application and agreement and to provide such additional information as may be requested.
SECTION 4: That the City of Foley’s attorney has reviewed the FAA application, offer, and acceptance documents and determined that the City of Foley has the legal authority and power to enter into the airport funding agreement with the FAA.
SECTION 5: That the City of Foley hereby affirms that the local matching share of the money required to complete the drainage improvement project has been or is hereby officially approved, placed in the budget, and is available for expenditure upon execution of the FAA funding agreement and the commencement of this project.
Section 6: That this Resolution shall become effective immediately upon its adoption as required by law.
