Gregory Scott and Lindsey Driskell, owners of Fish River Furnishings, are leasing the former CVB building. They have opened Gypsy Queen Java in the location. Rental fee of $800 per month plus all utilities placed in their name with a 12 month lease that will automatically renew for a period of two years, which will expire on September 30, 2022. Each party can terminate this agreement with a 90 day notice on each anniversary date. A new sublease will be executed for a term effective on September 30, 2022 - September 30, 2024.

WHEREAS,the City is the lessee under that certain Lease Agreement dated August 3, 2009 (the “Lease Agreement”) by and among the City, as lessee, and South Baldwin Museum Foundation, Inc., as lessor, for the lease of that certain improved real property located at 111 West Laurel Avenue, Foley, Alabama, containing 1,480 square feet +/-, together with the right of use of all means of ingress and egress and all other general common facilities contained in the building, as well as the sidewalks and parking facilities (the “Leased Premises”); and
WHEREAS, the City and the Subtenant desire to renew the sub-lease agreement of the Leased Premises to Gregory Scott and Lindsey Driskell for a term of two years which will expire on September 30, 2022, and
WHEREAS, each party can terminate this agreement with a 90 day notice on each anniversary date. A new sublease will be executed for a term effective on September 30, 2022 - September 30, 2024.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Authorizes the Mayor to sign a sublease agreement renewal with Gregory Scott and Lindsey Driskell for a two year term expiring on September 30, 2022.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
