NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Amends Resolution 15-2205 Section 2 to read:
Approves the sale of 1.37+/- acres of land located at the Northwest corner of the Wilson Pecan property to Craine Creek Farms in the amount of $35,000.00 for the construction and operation of a hydroponics production facility. If, at a later date the property becomes more valuable as a retail or restaurant location, Craine Creek Farms shall have the right to change their use or sell their property for retail or restaurant use subject to City approval. The City retains 1st Right of Refusal to purchase the land and improvements from Craine Creek Farms if the property comes up for sale. In the event Craine Creek Farms defaults on their loan, the City will have 1st Right of Refusal to purchase from the bank the property and improvements for the amount of debt owed to the bank. If the City does purchase the land and improvements, the property’s use will be restricted only by the City Zoning Ordinance that applies to that property.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
