Volkert had previously submitted Supplemental Agreement No. 2 in the amount of $180,281.00 for the repair of T-hangars damaged by Hurricane Sally. It has since been determined by Chuck Lay, Chief Building Inspector, that due to the severity of the damage, the units must be constructed in a manner that will bring them up to current code. To accomplish this, the units will have to be demolished and rebuilt. In addition, a fire hydrant will be installed on the north apron as one does not currently exist. The previous Volkert Agreement will be replaced by Supplemental Agreement No. 4 in the amount of $229,797.07 which includes all engineering cost associated with this project.

WHEREAS, the T-Hangars on the north apron of the Foley Municipal Airport were severely damaged by Hurricane Sally, and,
WHEREAS, the City of Foley entered into Supplemental Agreement No. 2 with Volkert, Inc. on February 15, 2021 by Resolution 21-1056-RES to provide engineering services related to the evaluation, design, bid and construction phases of this project for the contract amount of $180,281.00, and,
WHEREAS, due to the severity of the damage, it has since been determined by Foley's Chief Building Inspector that the units must be brought up to current code which will result in the demolition and replacement of the three hangar units and will include the installation of a fire hydrant near the north apron to service the three hangars, and,
WHEREAS, Volkert Inc. has updated their fee proposal and submitted Supplemental Agreement No. 4 reflecting an increase of $49,516.07 in Volkert's new contract amount making the total engineering service fee $229,797.07.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves Volkert Inc.'s Supplemental Agreement No. 4 in the amount of $229,797.07 which will replace Supplemental Agreement No. 2 which was approved by Resolution 21-1056-RES.
SECTION 2: Amends account 100-9200-5101 S03.1 E1 and account 100-9200-4703 Insurance Proceeds by an increase of $49,516.07 making the total cost for engineering services for this project $229,797.07.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
