A Resolution Acknowledging the Prior Transfer of The City-Owned Portion of The Roadway Now Designated as SR 161 to ALDOT and Providing for the Continued Local Recognition of the Name Foley-Beach Express Within The City of Foley

WHEREAS, the City of Foley (“City”) previously owned a portion of the roadway commonly known as the Foley-Beach Express and related right-of-way from where the roadway intersects with Alabama Highway 59 right-of-way on the northern side of the City to where the roadway intersects with County Road 12 South on the southeastern side of the City; and

 

WHEREAS, the southern boundary of the municipal limits of the City of Foley along the corridor historically known as the Foley-Beach Express lies approximately 2,500 feet north of Coastal Gateway Boulevard; and

 

WHEREAS, the City Council previously approved the transfer of the City’s portion of the Foley-Beach Express to the Alabama Department of Transportation (“ALDOT”), and such transfer has since been completed in accordance with applicable law; and

 

WHEREAS, following ALDOT’s acquisition and integration of the corridor into the state highway system, the roadway is now officially designated as State Route 161 (SR 161); and

 

WHEREAS, the City Council recognizes that the name Foley-Beach Express has long-standing historical, geographic, geographic, and economic significance to the City of Foley and the surrounding region; and

 

WHEREAS, the City Council desires to formally acknowledge that, notwithstanding the official state highway designation of SR 161, the portion of the roadway located within the municipal jurisdiction of the City of Foley shall continue to be locally and historically recognized as the Foley-Beach Express.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, as follows:

 

SECTION 1: The City Council hereby acknowledges and affirms the prior approval and completed transfer of the City’s portion of the roadway now designated as State Route 161 to ALDOT.

 

SECTION 2: The City Council hereby declares that the portion of State Route 161 located within the municipal limits of the City of Foley shall continue to be locally recognized and referenced as the Foley Beach Express for historical, geographic, and community identification purposes.

 

SECTION 3: Nothing in this Resolution shall be construed to alter, amend, or conflict with the official designation of the roadway as State Route 161 as established by ALDOT.

 

SECTION 4: The officers and employees of the City are authorized to reference the name Foley-Beach Express in City communications, mapping, wayfinding, and informational materials when referring to the portion of State Route 161 located within the City limits, where appropriate.

 

SECTION 5: This Resolution shall become effective immediately upon its adoption.
