A Resolution Fixing the Costs Associated with 118 W Laurel Avenue

The City of Foley solicited request for proposals to assure that the interior of the building would be sealed from further water damage and deterioration resulting from water/moisture intrusion through the roof, walls and/or all associated roof components in and adjacent to the roof and windows. Highland Wake Construction was chosen to do the work in the amount of $99,023. During the progression of the work more structural damage was found and totalled $1,816.64. The parapet wall and cap required grouting and some minor brick mortar work was needed for an additional cost of $2,985.74. The total amount of the changes was $4,802.38 making the total payment to Highland Wake Construction $103,825.38. According to State law the final assessment is due and payable within 30 days. If the owners want to pay the final assessment in ten annual installments interest may be acrued not exceeding 12 percent per annum. The Council must decide on the percentage rate.

WHEREAS, a public hearing was held on Tuesday, September 3, 2013 to fix to costs for securing and repairing the building at 118 West Laurel Avenue, Foley, Alabama 36535, in accordance with the Code of Alabama, Section 11-53B-5, and
WHEREAS, Highland Wake Construction was chosen to do the work in the amount of $99,023, and
WHEREAS, during the course of the repairs Highland found the following items that needed to be repaired:
Structural Repairs $1,816.64
Parapet Wall & Cap Grouting and Brick Mortar Work $2,985.74
WHEREAS, the total of additional repairs are $4,802.38 plus an administration fee of $200.00 making the total cost $104,025.38.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves fixing the costs at a total of $104,025.38, which shall constitute a final assessment against the lot or parcel of land upon which the building is located and shall constitute a lien on the property for the final amount of the assessment.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
