A RESOLUTION TO SET A PUBLIC HEARING TO CONSIDER AN ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY OWNED BY ROLLING STONES, LLC FROM B-1A (EXTENDED BUSINESS) TO B-3 (LOCAL BUSINESS)

WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a new Zoning Ordinance and Zoning Map for the City of Foley, which has subsequently been amended; and
WHEREAS, the Foley Planning Commission has recommended approval of the rezoning of certain property within the City of Foley; and
WHEREAS, the City of Foley has received a request to rezone property owned by Rolling Stones, LLC from B-1A (Extended Business) to B-3 (Local Business); and
WHEREAS, the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City, to consider amending said Ordinance; and
WHEREAS, all requirements of the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met; and
WHEREAS, the City Council of the City of Foley, Alabama, deems it necessary and proper to set a public hearing to receive comments and consider an ordinance amending Ordinance No. 387-87 to rezone property owned by Rolling Stones, LLC from B-1A (Extended Business) to B-3 (Local Business).
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Sets a public hearing for October 5, 2026, at 4 p.m., in the Council Chambers at Foley City Hall, 407 East Laurel Avenue, Foley, Alabama, to consider an Ordinance Amending Ordinance No. 387-87 by rezoning property owned by Rolling Stones, LLC from B-1A (Extended Business) to B-3 (Local Business), said property being located north of U.S. Highway 98 between Bender Road and Springsteen Road, and more particularly described as follows:

SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
