ORDINANCE AMENDING ORDINANCE NO. 387-87 PREZONING PROPERTY

ON KELLER ROAD ANNEXED VIA LEGISLATIVE ACT

 

                     WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a new Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

                     WHEREAS, the City of Foley has received a request that specific property within the City be pre-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

                     WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met,

                     NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session accepted the following changes:

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to pre-zone property being annexed via Legislative Act, said property description as follows:

 

TO BE ZONED AO - AGRICULTURAL OPEN SPACE:

 

Tract 1:

As recorded in real property book 95, page 1167 in the records of the office of Judge of Probate Court of Baldwin County, Alabama: The northeast quarter of the northeast quarter of Section 21, Township 8 South, Range 4 East, containing 40.0 acres, more or less. (Pin 20853-Horne).

 

Tract 2:

As recorded in real property book 685, page 1691 in the records of the office of Judge of Probate Court of Baldwin County, Alabama:

Parcel A:  The southeast quarter of the northwest quarter of the northeast quarter Section 21, Township 8 South, Range 4 East, Baldwin County, Alabama. (Pin 37103 - Davis).

 

Tract 6:

As recorded in Instrument number 1420784 in the records of the office of Judge of Probate Court of Baldwin County, Alabama:

Commencing at the northeast corner of Section 21, Township 8 South, Range 4 East, Baldwin County, Alabama; thence run south 89° 53’ 53” west, 1338.12 feet to a found nail and cap; thence run south 00° 09’ 44” west, 662.69 feet to a crimp top iron found and the point beginning; thence from said point of beginning, run south 00° 14’ 05” west, 331.43 feet to a capped iron set (CA #031LS); thence run north 89° 50’ 59” west, 669.48 feet to a capped rebar found; thence run north 00° 10’ 17” east, 331.19 feet to rebar found; thence run south 89° 52’ 14” east, 669.85 feet to the point of beginning; the above described parcel lying in the southeast quarter of the northwest quarter of the northeast quarter of Section 21, Township 8 South, Range 4 East, Baldwin County, Alabama. Commencing at the southwest corner of Section 15, Township 8 South, Range 4 East, run south 89° 42’ 56” east along the south line of said Section 15, 419.60 feet to the point of beginning; run thence north 00° 08’ 52” east, 748.52; thence run north 89° 43’ 56” east, 244.33 feet; thence run south 00° 09’ 52” west, 750.87 feet to a point on the south line of said Section 15; thence run north 89° 42’ 56” west along said south line 244.26 feet to the point of beginning.  All lying in Section 15, Township 8 South, Range 4 East, Baldwin County, Alabama. Being in Section 21, Township 8 South, Range 4 East, Baldwin County, Alabama, and being more particularly described as follows:  commence at the northeast corner of Section 21, Township 8 South, Range 4 East, Baldwin County, Alabama; thence north 90° 00’ 00” west, 1992.00 feet to a point; thence south 00° 10’ 05” west, 40.00 feet to an iron pin and the point of beginning on the south right of way of Keller Road (80’ ROW); thence south 00° 05’ 05” west, 622.29 feet to an iron pin; thence south 89° 59’ 10” west, 134.81 feet to an iron pin; thence south 89° 59’ 10” west, 218.03 feet to an iron pin (west boundary); ; thence north 00° 06’ 31” east, 622.32 feet to an iron pin on the south right of way of Keller Road (80’ ROW); thence along said right of way of Keller Road south 89° 55’ 58” east, 68.25 feet to an iron pin; thence run 90° south, 290 feet to a point; thence run 90° east, 150 feet to a point; thence run 90° north, 290 feet to a point; north 89° 57’ 40” east, 134.55 feet to an iron pin and the point of beginning.  (Less and except Pin 105022- Gilley). Commencing at the northeast corner of Section 21, Township 8 South, Range 4 East, run west along the north line of said Section 21, 1992 feet to a point; thence run south 00° 10’ 05” west, 40 feet to a point on the south right of way line of Keller Road (County Road 10) for the point of beginning; continue then south 00° 10’ 05” west, 622.35 feet; thence run south 89° 55’ 56” east 652 feet, more or less, thence run north 00° 10’ 05” east, 622.29 feet to a point on the south right of way line of said Keller Road; thence run west along the south right of way line of Keller Road (County Road 10) 652 feet, more or less, to the point of beginning. SECTION 2: That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3:  This Ordinance shall become effective immediately upon its adoption as required by law.
